Here, even if you ahve gone beyond your contract and are paying month to month, the landlord will still usually write a 30 - 60 day notice clause in there. I have never rented in SC or I would have more to tell ya. Sorry hun. They won't throw you in jail, it isn't a criminal matter, it is civil and you can't go to jail for something civil. You won't go to jail. Its not a criminal offense to disagree with your landlord. Try and pay it like you planned, and follow up with the certified mail route. If he takes you to small claims court, show up with your receipt. You will owe him the money for the time you lived there, but probably not any punitive money. Even if you are outside of your lease terms, you are considered to be on a month to month basis and only required to pay for the time you live there. I know this is even the case when people who own their homes and pay association fees. If they sell their home, they are only responsible for the prorated amount of the association fee and the new owner picks up the balance. Where we live, the same goes for renters - in private and community rentals. There is no reason he should be able to make you pay for the entire month in my mind, but again, I don't know how the laws work in your state. Maybe you should look it up online?
